CIRCUMSTANCES
On 22 October 2017 at around 1030hrs, the now deceased arrived at Mother of Peace Community, Mutoko driving a silver Bluebird Sylphur motor vhicle registration number ACS 2232 Engine number 0G15408157 and chasis number FG10003768.
Upon arrival at the Mother of Peace Community, Mutoko, Plaxedes Kamundiya parked her motor vehicle, locked it and took the keys with her and was welcomed by the informant who is a Stores and House hospitality for mother of peace.She indicated that she was on a tour for assessment on preparations for a visit scheduled for the 27 October 2017 with Mass Savers Students from St Georges High School, Harare.
The informant and the Plaxedses Kamundiya talked about social life. The now deceased also talked about coming to Mother of Peace to present some donations to the home from St Georges Hartman House and she inquired on the clearance procedures to visit through Social Welfare. She also spent about half an hour singing with the children of Mother of Peace. During all this time Plaxedes Kamundiya did not show any signs of stress rather she was in a happy mood.
Plaxedes Kamundiya was told about the blue cross the Glorious Cross of life and she developed interest to visit that area. She was escorted by the informant up to the gate and then she concluded the journey alone which is about 80 meters due north from the Mother of Peace Community. She indicated that she wanted to spent not more than an hour praying.
The informant then slept and woke up at around 1630hrs only to realize that the motor vehicle of the now deceased was still parked. This surprised her since Plaxedes Kamundiya had told her that she wanted to return to Harare soon. The informant then asked the children who were in church whether they had seen the now deceased and the children said they did not.
The informant then sent James CHINAMANO NR not registered aged 17 years and Simon MUHAMBA NR not registered aged 17 who are both orphans at Mother of Peace to look for the now deceased at blue cross ,the Glorious Cross of life. The two returned to the informant and told her that they did not find the now deceased but rather they had seen the accused person who indicated that he had seen the now deceased praying at the blue cross and had left saying she was going to Mushimbo.
The informant then teamed up with Beula MUSERE NR not held aged 44 years of Mother of Peace Community and went to the blue cross where they located the accused person who also indicated that he had seen the now deceased praying at the cross and that she said she was from Mushimbo area. The accused told the informant that the now deceased was showing as if she was mentally disturbed. They looked for the now deceased and did not locate her.
On 23 October 2017 at around 0600hrs, the informant teamed up with Panganai ROBERT NR 48-089886-P-48 Aged 37 years of Mutemwa Leprosy Care Centre, Mutoko and Givemore CHIBANDA NR not held aged 32 years of Mutemwa Leprosy Care Centre and continued to look for the now deceased.
During the search they again approached the accused who said same sentiments as per yesterday. The informant then opened the accused person’s monarch bag and discovered that it contained groceries which the accused said was given by his sister from Murewa to give her mother at his rural home at Chiuriri Village, Chief Mutoko, Mutoko which is about 15 kilometers from the Mutemwa Mountain.
Panganai ROBERT and Givemore CHIBANDA then went to Mutemwa Dam where they discovered the body of the now deceased floating in the dam.A report was then made to ZRP Mutoko Police Station.
On 23 October 2017, details from CID Mutoko and ZRP Mutoko attended the scene and the body was seen floating in the dam naked facing downwards.The body was retrieved from the water and bleeding from the nose.
After retrieving the body ,it was laid about six metres from the bank of the dam.The body was inspected and it was discovered that it had a swollen face, bruises under the right eye,bruises on the cheek which was swollen .The body had burst blisters on both legs.
Accused person was interviewed and confessed to have committed the offence of murder.Accused led the police to Chido Mudzinyama Farm which is about 1.5 kilometers due west where a church regalia with blood stained golden dress, pink size 6 pair of tennis shoes with white laces, navy blue laced braa and black hair band belonging to the now deceased were recovered wrapped in a white blood stained sack.The accused person also led to the recovery of the white blood stained pant and black skin tight which were on the side pocket of his monarch bag.
Accused led the police to the blue cross where struggle marks were observed showing that the now deceased was dragged 30 meters due west from the blue cross.In addition he also indicated to the police the place where he placed the body of the now deceased covered with tree branches about 30 meters from the blue cross.Furthermore he led to the recovery of the stone which he used to hit the now deceased on the right cheek which was about 22 meters from the blue cross.
The accused led the police to the dam where he had dumped the body of the now deceased.The body of the now deceased which was naked and was positively identified by the informant who had last seen her on 22 October 2017 at around 1200hrs.The deceased’s body was conveyed to Murewa Hospital and placed in a mortuary awaiting post mortem examination by the Pathologist.Mutoko Cr 97-10-17 refers.The accused person is held at Mutoko Police Station under DB 590-17 and will appear in court soon.
